San Jose man accused of fraud in cellphone tower lease

SAN FRANCISCO – A Virginia company has filed suit against a San Jose man alleging that he falsely misrepresented a cellphone tower lease.

LL B Sheet 1 LLC filed a complaint on April 29 in the U.S. District Court for the Northern District of California against Michael J. Loskutoff, individually and as a representative trustee for the Michael John Loskutoff Trust dated Nov. 20, 1992; and Does 1 through 10, citing intentional misrepresentation, negligent misrepresentation, fraud by concealment and breach of contract.

According to the complaint, the plaintiff alleges that its business purpose is to acquire cellphone tower leases. The plaintiff alleges that the defendant represented that a tower in Sunnyvale as a carrier of AT&T, but in fact AT&T had terminated its contract with the defendant.

The plaintiff requests a trial by jury and seeks past and future economic damages, exemplary damages, interest, all legal fees and any other relief as this court deems just. It is represented by Ryan D. Saba of Rosen Saba LLP in Beverly Hills.
