Pikamab alleges Alabama university, researcher breached contract

SAN FRANCISCO – A Menlo Park corporation is suing an Alabama academic institution and a researcher alleging they failed to perform medical studies after signing a contract.

Pikamab Inc. filed a complaint on April 30 in the U.S. District Court for the Northern District of California against The University of Alabama, Birmingham and Robert P. Kimberly, citing breach of contract, fraud and negligence.

According to the complaint, the plaintiff alleges that it allegedly entered into a contractual agreement with the defendants for the research and development of a certain medical product but claims the defendants have failed to perform all their contractual obligations. The plaintiff alleges it was unable to close on financing of at least $11 million due to the defendants' conduct.

The plaintiff requests a trial by jury and seeks compensatory damages to be determined in trial but not less than $11 million, exemplary damages, interest, all legal fees and any other relief as this court deems just. It is represented by Perry J. Narancic of Lexanalytica PC in Campbell.
