Funds alleged Shasta Constructors did not pay contributions

SAN FRANCISCO – Several trust funds allege that an employer failed to pay its contributions per a bargaining agreement.

Operating Engineers' Health and Welfare Trust Fund for Northern California; Pension Trust Fund for Operating Engineers; Pensioned Operating Engineers' Health and Welfare Trust Fund; et al. filed a complaint on May 4 in the U.S. District Court for the Northern District of California against Shasta Constructors Inc. citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that between Jan. 1, 2013, and Dec. 31, 2014, it suffered damages as a result of unpaid contributions from the defendant. The plaintiffs hold Shasta Constructors Inc. responsible because the defendant allegedly failed to pay contributions on behalf of its employees in violation of the bargaining agreement between the parties.

The plaintiffs seek unpaid contributions, liquidated damages on all late and unpaid contributions plus interest, all legal fees and any other relief as the court deems just. They are represented by Michele R. Stafford and Timothy A. Froehle of Saltzman & Johnson Law Corp. in San Francisco.
