Souza and Viviani Plumbing Co. Inc. alleged to have not paid overtime wages

SAN FRANCISCO – A plumber is suing his former employer over allegations of unpaid wages.

David Gauthier filed a complaint on May 3 in the U.S. District Court for the Northern District of California against Souza and Viviani Plumbing Co. Inc. and John Phillip Monacelli alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between July 2015 and January he worked for more than 40 hours during his employment but did not receive any overtime pay at the appropriate rate defined by the FLSA. The plaintiff holds Souza and Viviani Plumbing Co. Inc. and John Phillip Monacelli responsible because the defendants allegedly failed to pay overtime wages and that his wage stubs did not list all of his work hours or his employer's contact information.

The plaintiff seeks compensatory damages for all wages and overtime wages earned but not paid, liquidated damages equal to the unpaid overtime wages, interest rate of 10 percent, all legal fees and any other relief as this court deems just. He is represented by Tomas E. Margain and Huy Tran of Justice at Work Law Group in San Jose.
