SAN JOSE – A Santa Clara County woman alleges that her insurance company has violated the terms of her long-term disability plan and has wrongfully terminated her benefits.
Ronda Liesenberg filed a complaint on May 5 in the U.S. District Court for the Northern District of California, San Jose Division against Liberty Life Assurance Co. of Boston and Adobe Systems Inc. Group Disability Income Plan citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that since June 2009, she has been disabled due to several medical conditions and applied for long-term disability benefits while her plan was still in full effect. The plaintiff holds Liberty Life Assurance Co. of Boston and Adobe Systems Inc. Group Disability Income Plan responsible because the defendants allegedly terminated plaintiff's benefits multiple times after appeals, most recently in 2015, despite still being disabled under the terms of the plan.
The plaintiff seeks order to pay long-term disability benefits plus interest, order her rights to receive future payments, all legal fees and any other relief as this court deems just.
