Transportation companies facing suit from insurer over allegedly stolen cargo

SACRAMENTO – An insurance firm has filed suit against several transportation companies alleging they failed to deliver cargo.

National Union Fire Insurance Co. of Pittsburgh Pa. filed a complaint on April 4 in the U.S. District Court for the Eastern District of California against Diversified Transportation Services, California Freight, H&M Trucking and Does 1 through 10 citing injury or damage to cargo.

According to the complaint, the plaintiff alleges that in December 2014, it suffered damages as a result of the cargo of its insured, Baker Commodities Inc., being stolen en route. The plaintiff holds Diversified Transportation Services, California Freight, H&M Trucking and Does 1 through 10 responsible because the defendants allegedly failed to protect the cargo while being shipped to the consignee from Benicia to Las Vegas.

The plaintiff seeks value of the cargo in the amount of $216,340, incidental and consequential damages, interest, all legal fees and any other relief as this court deems just. It is represented by Adam C. Brown of Hill Rivkins Brown & Associates in Fair Oaks.
