Woman files suit for reinstatement of disability benefits from LINA

OAKLAND – A Contra Costa County woman alleges her disability benefits were wrongfully terminated.

Cindy Weese filed a complaint on May 6 in the U.S. District Court for the Northern District of California, Oakland Division against Life Insurance Co. of North America citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2015, she became disabled according to the terms of her plan but was denied of her plan benefits. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly initially approved plaintiff's claim for disability benefits in April 2015, but suddenly discontinued benefits in August 2015 based on one note from a physician stating that the plaintiff is in excellent condition. She alleges that the defendant failed to consider the findings of her other physicians and that she is still disabled under the terms of the plan.

The plaintiff requests a trial by jury and seeks order to pay benefits to plaintiff pursuant to the terms of the plan plus interest, reinstatement into the plan for as long as she remains disabled under the terms of the plan, all legal fees and any other relief as this court deems just.
