Bayliss Media Group alleges company continued to use materials after contract ended

SACRAMENTO – A Truckee business alleges that an Oakland-based business and individual are using its materials without authorization.

Bayliss Media Group filed a complaint on May 9 in the U.S. District Court for the Eastern District of California, Sacramento Division against David Hollander and Liberty Group LLC citing direct copyright infringement, contributory copyright infringement and breach of contract.

According to the complaint, the plaintiff alleges that in April 2015, it entered into a contract with the defendants with the stipulation that the plaintiff's materials may no longer be used when the contract is terminated. The suit states the defendants terminated the contract on June 30, 2015. The plaintiff holds David Hollander and Liberty Group LLC responsible because the defendants allegedly used plaintiff's materials even after their contract was terminated.

The plaintiff requests a trial by jury and seeks preliminary and permanent injunction against the defendant, actual damages plus interest, statutory damages of $150,000 per infringement, liquidated damages of $100,000, all legal fees and any other relief as the court deems just.
