Kern Radiology Imaging Systems files suit alleging CT system wasn't delivered

FRESNO – A Bakersfield company alleges that a Coral Springs limited liability company did not deliver medical equipment as promised and will not refund a deposit.

Kern Radiology Imaging Systems Inc. filed a complaint on May 10 in the U.S. District Court for the Eastern District of California, Fresno Division against Mei Development Corp., The Mei Healthcare Group LLC, Mei Healthcare Capital LLC and Philips Electronics North America Corp. citing breach of contract and other counts.

According to the complaint, the plaintiff alleges that on July 1, 2014, it entered into an agreement with the defendants for the purchase of a Philips PET CT scanning system. The suit states the plaintiff made a deposit of $573,617.50 toward the $1,780,923 purchase price. The plaintiff holds Mei Development Corp., The Mei Healthcare Group LLC, Mei Healthcare Capital LLC and Philips Electronics North America Corp. responsible because the defendants allegedly failed to deliver the Philips PET CT to plaintiff and when they could not deliver, failed to return the deposit plaintiff paid for despite several attempts by plaintiff.

The plaintiff seeks restitution in the amount of $573,617.50, compensatory damages, consequential damages in the mount of $187,580.77, interest, all legal fees and any other relief as the court deems just.
