SAN JOSE – A San Jose man alleges he was called at a harassing rate regarding a student loan.
Stephen Nicholson filed a complaint on May 10 in the U.S. District Court for the Northern District of California, San Jose Division against Navient Solutions Inc., formerly known as Sallie Mae Inc., citing violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that the defendant has contacted him up to three times per day regarding a student loan account. The plaintiff holds Navient Solutions responsible because the defendant allegedly kept on calling him despite his several requests to stop and that the defendant used an automatic telephone dialing system.
The plaintiff seeks statutory damages, all legal fees and any other relief as the court deems just. He is represented by Michael S. Agruss of Agruss Law Firm LLC in Chicago.
