SACRAMENTO – A man has filed suit against a Sacramento employer and its owner over allegations he was not paid overtime.
Kurtis Kesel filed a complaint on May 11 in the U.S. District Court for the Eastern District of California against Hat World Inc. and Genesco Inc. citing violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between March 20, 2008, and Nov. 27, 2015, he worked for more than 50 hours a week but was not paid any overtime compensation. The plaintiff holds Hat World Inc. and Genesco Inc. responsible because the defendants allegedly refused to show plaintiff's records when requested and pay his overtime wages, even though his position was classified as nonexempt.
The plaintiff requests a trial by jury and seeks damages for unpaid overtime compensation in an amount of more than $56,291; liquidated damages in the amount of more than $56,291; damages in an amount of $4,615; $750 for failure to show records to plaintiff in a timely manner; restitution; interest; all legal fees and any other relief as this court deems just.
