Woman claims Metropolitan Life Insurance Co. wrongfully terminated her benefits

SAN FRANCISCO – A pharmacist alleges she was wrongfully terminated from her disability benefit plan.

Shawlang Chao filed a complaint on May 11 in the U.S. District Court for the Northern District of California against Metropolitan Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled in March 2013 and was initially approved for benefits by the defendant in July 2013. She alleges that the defendant suddenly terminated her benefits in August 2014. The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant allegedly terminated her disability benefits based upon its allegation that she no longer meets the definition of disabled under the plan terms.

The plaintiff seeks an order for the defendant to pay all long-term disability benefits to plaintiff plus interest, surcharges payable to plaintiff, interest, all legal fees and any other relief as the court deems just. She is represented by Scott Kalkin of Roboostoff & Kalkin in San Francisco.
