SAN FRANCISCO – A San Francisco man is suing a Massachusetts debt collector alleging it contacted him in the middle of night to collect a debt he isn't responsible for repaying.
Miguel Pineda filed a complaint on May 12 in the U.S. District Court for the Northern District of California against Collectco Inc., doing business as EOS CCA, and Does 1-10 alleging violation of the Fair Debt Collection Practices Act, the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that he was contacted by the defendant in an attempt to collect a purported debt owed by his mother. The plaintiff holds Collectco Inc. and Does 1-10 responsible because the defendant allegedly called plaintiff in the middle of the night and used an automated telephone dialing system.
The plaintiff requests a trial by jury and seeks statutory damages, treble damages, all legal fees and any other relief as the court deems just. He is represented by Tammy Hussin of Hussin Law in Carlsbad.
