SAN FRANCISCO – A harbor district is suing a vessel and its owner over an allegedly unpaid debt.
Crescent City Harbor filed a complaint on April 22 in the U.S. District Court for the Northern District of California against vessel Linda Dawn and owner Marty R. Lopez alleging that they failed to pay the vessel's berthing fees.
According to the complaint, the plaintiff alleges that it and Lopez entered into a berthing permit and rental agreement for the Linda Dawn. The plaintiff holds the defendants responsible because Lopez has allegedly failed to pay yearly berthing fees since September 2014 despite plaintiff's demands. The suit states the vessel sank on March 22.
The plaintiff seeks judgment against the defendant in the amount of $25,068 for berthage fees plus interest, $6,000 for legal fees, interest, and all other relief as the court deems just. It is represented by Robert N. Black, Martha D. Rice and Autumn E. Luna of Black & Rice LLP in Crescent City.
