Therapy Stores Inc. seeks declaratory judgment in trademark dispute

SAN FRANCISCO – Three clothing retail businesses are in dispute over the use of the trademark Therapy.

Therapy Stores Inc. filed a complaint on May 13 in the U.S. District Court for the Northern District of California against JGV Apparel Group LLC and Lane Crawford LLC seeking declaratory judgment of non-infringement of trademark rights.

According to the complaint, the plaintiff alleges that it operates 11 retail stories in the Greater San Francisco Bay area and has done so under the Therapy name for 22 years. The plaintiff holds JGV Apparel Group LLC and Lane Crawford LLC responsible because the defendants allegedly claim that they are the owners of the infringing mark, but the plaintiff was purportedly the first to use the Therapy mark for its business.

The plaintiff requests a trial by jury, an order that the plaintiff does not infringe any of the purported trademark rights of the defendant, permanent injunction, declaratory judgment, injunction against the defendant, order prohibiting the defendant from further infringing plaintiff's trademark, damages sufficient to compensate plaintiff, all damages, all legal fees and any other relief as this court deems just.
