SAN FRANCISCO – A California man alleges he was falsely arrested.

Tony Nguyen filed a complaint on May 13 in the U.S. District Court for the Northern District of California against the city and county of San Francisco; Sgt. Flint T. Paul; Lt. IM; Officers Galligan, Dudley, Gilman, Shih and Morales; and Does 1-20, citing alleged violation of civil rights; negligent training, retention and hiring; assault; battery; false arrest; and intentional infliction of emotional distress.

According to the complaint, the plaintiff alleges that on June 27, 2015, the defendants allegedly used excessive force while attempting to arrest him for expressing his concerns on how the officers were handling a female subject. He alleges that the woman was being treated in a manner that appeared excessively forceful and unnecessary. The suit states that no criminal charges were filed against the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant, all damages, enjoining the defendant from further violation, injunctive relief, interest, all legal fees and any other relief as this court deems just. He is represented by Elisa J. Stewart and Wendy E. Musell of Stewart & Musell LLP in San Francisco.
