SACRAMENTO – A Cook County, Illinois man has filed suit against two Bakersfield companies alleging that they failed to pay him for his share of a property rental.
Robert J. Newman Jr. filed a complaint on May 16 in the U.S. District Court for the Eastern District of California against the Treble LLC and 3MB LLC, citing breach of contract, fraudulent concealment and other counts.
According to the complaint, the plaintiff alleges that between May 2014 to September 2015 and in April 2016, he suffered damages as a result of an unpaid monthly 2 percent rental share. The plaintiff holds Treble LLC and 3MB LLC responsible because the alleged lack of payments violated the property purchase agreement the parties made and that the defendants failed to let the plaintiff review the defendants' accounts, books and records.
The plaintiff requests a trial by jury and seeks all damages, interest for all amounts due to plaintiff at the legal rate of 10 percent per annum, punitive damages, all legal fees and any other relief as this court deems just. He is represented by Eileen M. Diepenbrock and David A. Diepenbrock of Diepenbrock Elkin Gleason LLP in Sacramento.
