SACRAMENTO – A disabled welder has filed a suit against his pension plan for disability benefit coverage.
Darryl Evans filed a complaint on May 17 in the U.S. District Court for the Eastern District of California against Boilermaker-Blacksmith National Pension Trust and the board of trustees of the Boilermaker-Blacksmith National Pension Trust, citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that he has been disabled since 2009. The suit states he filed for disability pension benefits under the defendants' plan in March 2015. The plaintiff holds Boilermaker-Blacksmith National Pension Trust and Board of Trustees of the Boilermaker-Blacksmith National Pension Trust responsible because the defendants allegedly denied plaintiff's disability benefits based on their reason that he did not have 120 hours of service in the plan credit year to qualify.
The plaintiff seeks pay disability benefit from Dec. 1, 2011, until date of judgment, declaration of his right to receive future benefits, all legal fees and any other relief as the court deems just.
