Family files suit against Santa Rosa Memorial Hospital over woman's care

SAN FRANCISCO – A family has filed suit against a Santa Rosa medical provider alleging it failed to provide standard and reasonable care.

Cynthia Gutierrez, Jose Huerta and their minor children SMH, RH and AH filed a complaint on May 17 in the U.S. District Court for the Northern District of California against Santa Rosa Memorial Hospital, St. Joseph Health and Does 1-50 citing negligence and the violation of the Emergency Medical Treatment and Labor Act.

According to the complaint, the plaintiffs allege that on Feb, 25, 2015, Cynthia Gutierrez, 33, went to the emergency room at Santa Rosa Memorial Hospital, where she was treated and released. The plaintiff alleges that she collapsed in the waiting room, was resuscitated and transferred to the intensive care unit. The suit states she remains in a coma. The plaintiffs hold Santa Rosa Memorial Hospital, St. Joseph Health and Does 1-50 responsible because the defendants allegedly ignored test results and failed to stabilize Cynthia Gutierrez.

The plaintiffs request a trial by jury and seek all damages, enhanced remedies, EMTALA-related remedies, interest in the amount of 10 percent per year or at the maximum rate allowed by the law, all legal fees and any other relief as the court deems just.
