Ventana Medical Systems Inc. seeks declaration regarding patent

SAN FRANCISCO – A Pleasanton company is seeking declaration from the court over a patent licensed by a Sunnyvale company.

Ventana Medical Systems Inc. filed a complaint on May 18 in the U.S. District Court for the Northern District of California against Hologic Inc. seeking declaration of non-infringement and invalidity of a patent.

According to the complaint, the plaintiff alleges that it believes the '369 patent regarding prostate cancer is invalid and informed the defendant as such in December 2015. The plaintiff now seeks the court's declaration that a prostate cancer test product the plaintiff sells does not infringe on this patent.

The plaintiff requests a trial by jury and seeks judgment that the claims of '369 patent are invalid, all legal fees and any other relief as this court deems just. It is represented by Daralyn J. Durie and Adam R. Brausa of Durie Tangri LLP in San Francisco.
