SACRAMENTO – An Anderson couple is suing several pharmaceutical companies alleging that it manufactured a defective birth control implant.

Chaundra Wilbur and Robert Wilbur filed a complaint on May 21 in the U.S. District Court for the Eastern District of California against Schering-Plough Corp., Merck Sharp & Dohme Corp., Merck & Co. Inc. and John Doe entities alleging that they manufactured and sold defective products to consumers.

According to the complaint, the plaintiffs allege that in 2014, Chaundra Wilbur suffered severed damages to her body as a result of the Implanon implant migrating beyond the implant site. The plaintiffs holds Schering-Plough Corporation, Merck Sharp & Dohme Corp., Merck & Co. Inc. and John Doe entities responsible because the defendants allegedly knew the risk of spontaneous migration of the implant after insertion but did not provide accurate warning of this risk.

The plaintiffs request a trial by jury and seek all damages, medical expenses, other damages in excess of $75,000, interest, all legal fees and any other relief as this court deems just. They are represented by James G. O'Brien of Zoll & Kranz LLC in Toledo, Ohio.
