Woman accuses Unum Life Insurance Co. of wrongfully denying benefits

SAN FRANCISCO – A Marin County woman alleges she is disabled and was wrongfully denied long-term disability benefits.

Sara Nesson filed a complaint on May 25 in the U.S. District Court for the Northern District of California against Unum Life Insurance Co. of America, alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2014, she was diagnosed with chronic fatigue syndrome that hinders her from performing her every day duties. The plaintiff alleges she filed for a disability benefits in June 2015 but was denied by the defendant. The plaintiff holds Unum Life Insurance Co. of America responsible because the defendant allegedly continued to ignore all the medical evidence presented by the plaintiff to deny her benefit cliam.

The plaintiff seeks order for the defendant to pay disability benefits to plaintiff, declare plaintiff's right to receive the benefits for as long as she is disabled under the terms of the plan, all legal fees and any other relief as this court deems just. She is represented by Michelle L. Roberts of SSR Law Group in Alameda.
