SAN JOSE – Two individuals have filed a class-action lawsuit against several insurance companies alleging treatment coverage was wrongfully denied to them.

Charles Des Roches, on behalf of his beneficiary son R.D., and Sylvia Meyer filed a complaint on behalf of all others similarly situated on May 26 in the U.S. District Court for the Northern District of California against California Physicians' Service, doing business as Blue Shield of California; Human Affairs International of California; and Magellan Health Services of California, Inc.-Employer Services alleging breach of fiduciary duties and improper denial of benefits.

According to the complaint, the plaintiffs allege that substance abuse and mental health care and treatment for their minor children was denied by the defendants. The plaintiffs hold the defendants responsible because the defendants allegedly restricted insurance coverage for residential and intensive outpatient mental health and substance abuse treatment.

The plaintiffs seek all legal fees and any other relief as this court deems just. They are represented by Meiram Bendat of Psych-Appeal Inc. in West Hollywood; Daniel L. Berger, Kyle J.
