Randy's Trucking Inc. alleged to have not paid employees overtime

BAKERSFIELD – A class-action suit has been filed against a Kern County oilfield service company over allegations it did not pay employees overtime.

William Phillips filed a complaint on behalf of all others similarly situated on May 27 in the U.S. District Court for the Eastern District of California, Bakersfield Division against Randy's Trucking Inc., Randy Gene Griffith and Kyle Griffith, citing violation of state labor codes and the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Aug. 4, 2011, and March 28, 2014, he worked for more than 40 hours without receiving any overtime wages from the defendants or meal breaks. The plaintiff holds Randy's Trucking Inc., Randy Gene Griffith and Kyle Griffith responsible because the defendants allegedly failed to pay overtime wages to plaintiff for all hours worked in excess of 40 per work week.

The plaintiff requests a trial by jury and seeks overtime wages not paid in an amount in excess of $45,000, liquidated damages, unpaid premium meals, penalties and damages in an amount of $6,840, restitution and disgorgement, interest, all legal fees and any other relief as the court deems just.
