Yahoo alleges unknown individuals used mark for support scam

Trademark 06

SAN JOSE – A Sunnyvale company alleges unknown individuals used its trademark to falsely advertise they were affiliated with the company for technical support scams.

Yahoo Inc. filed a complaint on May 27 in the U.S. District Court for the Northern District of California, San Jose Division against 510 unknown defendants alleging false designation of origin and unfair competition, trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation. The plaintiff holds the unknown defendants responsible because the defendants allegedly used plaintiff's trademark in order to acquire sensitive information from plaintiff's users by presenting themselves as technical support for Yahoo.

The plaintiff requests a trial by jury and seeks permanent injunction restraining and enjoining defendants from infringing use of its trademarks, all damages sustained, all legal fees and any other relief as this court deems just. It is represented by Jeffrey B. Coopersmith and Tom Wyrwich of Davis Wright Tremaine LLP in Seattle, Washington and Kelly M. Gorton of Davis Wright Tremaine LLP in San Francisco.
