Insurance firms seek reimbursement for settlement

FRESNO – An Ohio-based insurance firm has filed suit against a Nebraska-based insurance company seeking declaratory relief regarding a settlement.

Great American Insurance Co. and Great American Insurance Co. of New York filed a complaint on May 31 in the U.S. District Court for the Eastern District of California, Fresno Division against Central National Insurance Co. of Omaha, Oakwood Insurance Co. and Does 1-10, citing equitable contribution, equitable subrogation, equitable indemnity and reimbursement of money.

According to the complaint, the plaintiffs allege that in 2014, they paid $172,974.50 for the defense of a client in a lawsuit and additional amounts in the settlement. The suit states that the defendants insured another party in that lawsuit and that the plaintiffs requested the defendants contribute to the defense and settlement of the claims, which they have declined.

The plaintiffs seek reimbursement, all legal fees and any other relief as the court deems just. They are represented by William J. Baron and Colleen A. Cassidy of Duane Morris LLP in San Francisco.
