SACRAMENTO – A man alleges his benefits were wrongfully terminated after receiving them for several years.
Scott Ingram filed a complaint on March 29 in the U.S. District Court for the Eastern District of California against The Prudential Insurance Co. of America and Rexel Holdings USA Corp. Long Term Disability Plan citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that between 2013 and 2016, he was disabled and initially received disability plan benefits but was suddenly terminated by the defendants. The plaintiff holds The Prudential Insurance Co. of America; and Rexel Holdings USA Corp. Long Term Disability Plan responsible because the defendants allegedly denied plaintiff of his disability benefits despite being disabled in accordance to the terms of the plan.
The plaintiff seeks award of benefits plus interest, order that plaintiff is eligible to receive future benefits, all legal fees and any other relief as this court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
