SAN FRANCISCO – A disabled man alleges he was terminated from receiving disability benefits because his insurer claims he is able to work.
Kevin A. Davidson filed a complaint on June 1 in the U.S. District Court for the Northern District of California against The Prudential Insurance Co. of America, Fair Isaac Corp. Short Term Disability Insurance Plan, Fair Isaac Corp. Long Term Disability Insurance Plan, Fair Isaac Corp., and Does 1-10 alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that between March 25, 2013, and March 27, 2013, he was initially paid for disability benefits but was suddenly terminated by the defendants. The plaintiff holds the defendants responsible because the defendants allegedly discontinued paying disability benefits to plaintiff despite his condition having no improvement.
The plaintiff seeks payment of benefits due to him, payment of future benefits until such time as he is no longer disabled within the terms of the plan, interest, all legal fees and any other relief as this court deems just. He is represented by John Robert Unruh of Unruh Law PC in San Francisco.
