Driller alleges he was misclassified and wasn't paid overtime

SACRAMENTO – An Indiana man alleges he was misclassified as an independent contractor and was not paid overtime.

Marc McCulloch filed a complaint on behalf of others similarly situated, and on behalf of the general public on Feb. 3 in the U.S. District Court for the Eastern District of California against Baker Hughes Inteq Drilling Fluids Inc., Baker Hughes Inc. and Does 1-50 alleging violation of the Fair Labor Standards Act and state wage laws.

According to the complaint, the plaintiff alleges that between May 2011 and August 2015, he worked for more than 40 hours at a given work week but was not paid any overtime compensation. The plaintiff holds Baker Hughes Inteq Drilling Fluids Inc., Baker Hughes Inc. and Does 1-50 responsible because the defendants allegedly failed to pay overtime wages to their employees.

The plaintiff requests a trial by jury and seeks all unpaid overtime compensation, unpaid meal and rest premiums, all damages, liquidated damages, interest, all legal fees and any other relief as this court deems just. He is represented by Daniel S. Brome of Nichols Kaster LLP in San Francisco and Michele R. Fisher of Nichols Kaster LLP in Minneapolis.
