SAN FRANCISCO – Two men who were employed as general and skilled laborers for the maintenance and construction of telecommunications lines allege their former employers did not properly pay them and have filed a class-action suit.

Jose Hernandez and Giovanni Hernandez filed a complaint on behalf of all others similarly situated on June 3 in the U.S. District Court for the Northern District of California against MP California, MP Nexlevel LLC, MP Nexlevel of California Inc. alleging violation of California wage and hour laws and the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that between June 2015 and March, they worked for more than 40 hours per workweek but they were not paid any overtime wages or were given a second meal break when they worked for more than 10 hours per day. The plaintiffs holds MP California, MP Nexlevel LLC, MP Nexlevel of California Inc., and Does 1 to 100 responsible because the defendants allegedly failed to pay any overtime compensation to their employees and for time spent for traveling to different job sites.

The plaintiffs request a trial by jury and seek all wages earned an owing in the amount of $1,000,000 plus interest, liquidated damages, $250,000 for compensatory damages, wages owing in the amount of $500,000, $100 per employee for each violation in the subsequent pay periods but not to exceed $4,000, all legal fees and any other relief as the court deems just. They are represented by Galen T. Shimoda and Justin P. Rodriguez of Shimoda Law Corp. in Elk Grove.
