Man seeks reinstatement of disability benefits

Insurance 09

SAN FRANCISCO – A San Francisco County man alleges that an insurance firm wrongfully terminated his claim for employee disability benefits.

Robert Galang filed a complaint on June 3 in the U.S. District Court for the Northern District of California against The Prudential Insurance Co. of America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that his claim for benefits was denied in May 2015 after having received them since 2013. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly denied plaintiff's claim for disability benefits despite his several appeals and despite having sufficient medical records to support his claim.

The plaintiff seeks award benefits to plaintiff plus interest and all other benefits from the plan, order that plaintiff is entitled to future disability benefits as long as he remains disabled as defined by the plan, all legal fees and any other relief as this court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
