Disabled man alleges his benefits were wrongfully terminated

SACRAMENTO – A Solano County man who was left disabled after a car accident alleges his insurance company wrongfully terminated his benefits.

Robert Latimer filed a complaint on Feb. 18 in the U.S. District Court for the Eastern District of California against The Lincoln National Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that his disability benefits were denied on Jan. 6, 2015, despite being paid benefits from July 5, 2013, until Feb. 27, 2015. The plaintiff holds The Lincoln National Life Insurance Co. and Does 1 to 10 responsible because the defendants allegedly denied plaintiff's long-term disability benefits despite having sufficient medical evidence to support his claim.

The plaintiff seeks all damages, long-term disability benefits payable at the rate of $1,657 per month from Feb. 28, 2015, until present; all legal fees; and any other relief as this court deems just. He is represented by Bernard R. Schwam of Law Office of Bernard R. Schwam in Encino.
