Phone 09

SACRAMENTO – A Vallejo resident has filed a class-action lawsuit against a Florida corporation alleging it made unsolicited and harassing phone calls to class members.

Laurel Collins filed a complaint on behalf of all others similarly situated on Feb. 12 in the U.S. District Court for the Eastern District of California against Education Source Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that between Nov. 25, 2015, and Nov. 30, 2015, she was called on her mobile telephone several times by the defendant without her consent. The plaintiff holds Education Source Inc. responsible because the defendant allegedly kept calling plaintiff using an autodialer despite being asked to stop calling.

The plaintiff requests a trial by jury and seeks injunctive relief, $1,500 as treble damages for each call that violated the TCPA, $500 as statutory damages for each violation of the TCPA, all legal fees, and any other relief as the court deems just. She is represented by L. Timothy Fisher, Annick M. Persinger and Yeremey O. Krivoshey of Bursor & Fisher PA in Walnut Creek and Scott A. Bursor of Bursor & Fisher PA in New York.
