LOS ANGELES – A Los Angeles County business alleges that another business in the county is selling bathroom tissue that infringes its trademark.
John Lee and Paper Plus Connection Inc. filed a complaint on Nov. 4 in the U.S. District Court for the Central District of California against Awad Haj, 97 Cent and More Discount Store and Does 1 - 10, alleging trademark infringement.
According to the complaint, the plaintiffs allege that they suffered damages to their business because of a similar product of bathroom tissue bearing a similar mark to its Mama Love being sold by the defendant under the mark Mama Luv. The plaintiffs hold Awad Haj, 97 Cent and More Discount Store and Does 1 - 10 responsible because the defendants allegedly used and distributed products that bear a similar mark as plaintiffs' products, which may and will cause confusion to plaintiffs' customers.
The plaintiffs request a trial by jury and seek judgment in favor of plaintiff, preliminary and permanent injunctive relief against the defendant, award profits derived from defendants' use of plaintiffs' mark, all damages, interest, all legal fees and any other relief as the court deems just.
