Hayward woman alleges Dish Network, retailer placed harassing phone calls

SAN FRANCISCO – A Hayward consumer has filed a class-action lawsuit against a satellite TV provider and a retailer alleging telephone harassment.

Cecilia Lopez filed a complaint on behalf of all others similarly situated on Feb. 17 in the U.S. District Court for the Northern District of California against Dish Network LLC and AMG Video and Communications alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that between Nov. 9, 2015, and Dec. 2, 2015, she was called on her mobile phone by the defendant several times without her prior consent. She alleges that she has never provided the defendants with her number and has not ever been in contact with them. The plaintiff holds Dish Network LLC and AMG Video and Communications responsible because the defendants allegedly used an autodialer or artificial pre-recorded voice to contact plaintiff in an attempt to collect a debt she purportedly owed.

The plaintiff requests a trial by jury and seeks injunctive relief, $1,500 as treble damages, $500 as statutory damages, all legal fees and any other relief as this court deems just.
