Produce company claims it wasn't paid for invoices

SAN JOSE – A San Jose wholesale produce company alleges it was not paid for deliveries.

Chong's Produce Inc. filed a complaint on June 8 in the U.S. District Court for the Northern District of California against Fresh & Best Produce Inc., Chong Suk Cho and Does 1 through 1, alleging failure to pay, breach of contract and other counts.

According to the complaint, the plaintiff alleges that between November 2015 and December 2015, it delivered fresh produce to the defendants but was not paid, damaging its business. The plaintiff holds Fresh & Best Produce Inc., Chong Suk Cho and Does 1 through 10 responsible because the defendants allegedly failed to timely pay each invoice for shipment of produce to plaintiff.

The plaintiff seeks payment of $8,514.50 plus interest, all legal fees and any other relief as the court deems just. It is represented by Susan E. Bishop of Berliner Cohen LLP in San Jose.
