SAN JOSE – Several labor group funds allege a California business did not pay contributions.
IBEW/NECA Sound and Communications Health and Welfare Trust, IBEW Ninth District Pension Trust, Northern California Joint Apprenticeship and Training Trust, et al. filed a complaint on June 10 in the U.S. District Court for the Northern District of California, San Jose Division against Corporate Construction Services Inc. citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that they suffered damages as a result of unpaid contributions from the defendant on behalf of its employees. The plaintiffs hold Corporate Construction Services Inc. responsible because the defendant allegedly failed to make monthly payments to the labor group as per their agreement.
The plaintiffs seek payment of $153,814.22, liquidated damages, interest, all legal fees and any other relief as the court deems just. They are represented by Benjamin K. Lunch and Wan Yan Ling of Neyhart, Anderson, Flynn & Grosboll in San Francisco.
