Woman seeks reinstatement of disability benefits

SACRAMENTO – A woman alleges her long-term disability benefits were wrongfully terminated and seeks reinstatement.

Dedra Espindola filed a complaint on June 13 in the U.S. District Court for the Eastern District of California against Standard Insurance Co. and DST Systems Inc., Long Term Disability Plan alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in Aug. 15, 2012, she suffered disability and filed a claim for disability benefits. While initially approved for the benefits, the defendant later terminated them on July 30, 2015, the suit states. The plaintiff holds Standard Insurance Co. and DST Systems Inc., Long Term Disability Plan responsible because the defendants allegedly terminated plaintiff's insurance benefits without providing any reasonable explanation nor performing adequate investigation and review for plaintiff's claim.

The plaintiff seeks payment of disability benefits due to plaintiff, reinstatement to the plan, interest, all legal fees and any other relief as this court deems just. She is represented by Glenn R. Kantor, Alan E. Kassan and Brent Dorian Brehm of Kantor & Kantor LLP in Northridge.
