Google, others face suit over Project Loon

SAN JOSE – An Arizona corporation alleges Google Inc. and two other companies breached a contract in their Project Loon.

Space Data Corp. filed a complaint on June 13 in the U.S. District Court for the Northern District of California, San Jose Division against X, Alphabet Inc. and Google Inc. alleging patent infringement, misappropriation of trade secrets and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of the infringement of its '941 and '522 patents. The patents deal with balloon-based communication platforms, the suit states. The plaintiff alleges that the defendants used these patents and confidential information in Project Loon in a breach of a nondisclosure agreement.

The plaintiff requests a trial by jury and seeks all damages, treble damages, to permanently enjoin the defendants, compensatory damages, punitive and/or exemplary damages, interest, all legal fees and any other relief as this court deems just.
