Unum Life alleged to have wrongfully terminated woman's benefits

SACRAMENTO – A woman alleges her long-term disability benefits were wrongfully terminated.

Anastasia Smith filed a complaint on June 14 in the U.S. District Court for the Eastern District of California citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she was found to be disabled under the terms of the plan and submitted a claim for benefits. While initially approved, it was later terminated by the defendant, the suit states. The plaintiff holds Unum Life Insurance Co. of America and Does 1 to 100 responsible because the defendants allegedly terminated payments for plaintiff's benefits despite adequate medical records to support her claim.

The plaintiff seeks all damages for failure to provide full benefits of the plan plus interest, all legal fees and any other relief as this court deems just. She is represented by David Allen of David Allen & Associates in Sacramento.
