Woman claims she is still disabled, files suit against LINA for benefits

SACRAMENTO – A woman alleges her insurance company wrongfully terminated her benefits because it claimed she was not longer disabled.

Erina Llamas filed a complaint on June 14 in the U.S. District Court for the Northern District of California against Life Insurance Co. of North America citing violation of the Employee Income Retirement Security Act.

According to the complaint, the plaintiff alleges that on June 19, 2013, she was found to be disabled and filed a claim for benefits, which was initially approved on July 12, 2013. On about Dec. 16, 2014, the suit states her disability benefits were suddenly terminated by the defendant. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly terminated plaintiff's disability benefits based on its information indicating that plaintiff did not meet the definition of disabled under the plan terms.

The plaintiff seeks pay all long term disability and waiver of life insurance premium benefits due plus interest, declare plaintiff's right to receive future long-term disability benefits, reinstatement, interest, all legal fees and any other relief as this court deems just. She is represented by Scott Kalkin of Roboostoff & Kalkin in San Francisco.
