Woman alleges she is disabled and was wrongfully denied benefits

SAN FRANCISCO – A Santa Clara County woman claims she was wrongfully denied disability benefits.

Karen Porter filed a complaint on June 14 in the U.S. District Court for the Northern District of California against Life Insurance Co. of North America citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she was found to be disabled according to the terms of the plan but was denied of any disability benefits by the defendant in 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied to pay plaintiff disability benefits claiming she did not meet the definition of disabled under the terms of the plan.

The plaintiff seeks payment of disability benefits due to her, declare that plaintiff is entitled to future benefits as long as she is disabled according to the terms of the plan, interest, all legal fees and any other relief as this court deems just. She is represented by Kathryn C. Curry and Tracy Tierney of GCA Law Partners LLP in Mountain View.
