SAN JOSE – A woman alleges her disability benefits were wrongfully terminated after an independent medical examination.

Lisa Griffith filed a complaint on June 15 in the U.S. District Court for the Northern District of California, San Jose Division against Principal Life Insurance Co. violation of the Employee Income Retirement Security Act.

According to the complaint, the plaintiff alleges that she experiences chronic back pain that impedes her from performing her daily duties. The suit states she filed for long-term disability benefits and while she was being paid for the benefits, the defendant discontinued paying them on March 26, 2015. The plaintiff holds Principal Life Insurance Co. responsible because the defendant allegedly discontinued to pay benefits to plaintiff based on its annual review and an independent medical examination despite plaintiff having adequate medical records to support her disability claim.

The plaintiff seeks payment of benefits to plaintiff plus interest, reinstatement to the plan for as long as she remains disabled under the terms of the plan, all legal fees and any other relief as this court deems just. She is represented by Michelle L. Roberts of Springer & Roberts LLP in Alameda.
