Class action filed against Theranos over fraud allegations

SAN FRANCISCO – Two Arizona consumers have filed a class-action lawsuit against a Palo Alto company and a drug store chain alleging false advertising of the accuracy of a blood test.

C.M. and S.G. filed a complaint on behalf of all others similarly situated on June 15 in the U.S. District Court for the Northern District of California against Theranos Inc. and Walgreens Boot Alliance Inc. alleging that they falsely advertise their products to consumers.

According to the complaint, the plaintiffs allege that in 2015, C.M. and S.G. both had medical conditions that required them to have regular blood tests. Both plaintiffs allege they were damaged as a result of buying the defendants' blood test kit, which was advertised as 100 percent accurate, but was found that it wasn't. The plaintiffs hold Theranos Inc. and Walgreens Boot Alliance Inc. responsible because the defendants allegedly failed to disclose to the consumers that their product is not 100 percent accurate.

The plaintiffs request a trial by jury and seek all damages, restitution and disgorgement, interest, all legal fees and any other relief as this court deems just. They are represented by Eric H.
