IPlay Group Inc. accused of selling counterfeit electronics cases

SAN FRANCISCO – A San Mateo business alleges a San Diego company is selling counterfeit versions of its products.

Speculative Product Design LLC, doing business as Speck Products, filed a complaint on June 16 in the U.S. District Court for the Northern District of California against IPlay Group Inc., doing business as iPlay N Talk, and Does 1-10, alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of its trademarked electronics protective carrying cases being infringed and sold to consumers, which purportedly is likely to cause confusion. The plaintiff holds IPlay Group Inc. and Does 1-10 responsible because the defendants allegedly manufactured and distributed infringing products that bear plaintiff's trademark.

The plaintiff requests a trial by jury and seeks damages to be proven in trial, restitution, to permanently enjoin the defendant and its agents, order to destroy all products that directly infringes plaintiff's trademark, treble damages, exemplary and punitive damages, all legal fees and any other relief as the court deems just.
