Woman files suit for reinstatement of disability benefits

SAN FRANCISCO – An Alameda County woman alleges her benefits were wrongfully terminated.

Patricia Perasso filed a complaint on June 17 in the U.S. District Court for the Northern District of California against the Hartford Life and Accident Insurance Co. and Group Long Term Disability Plan for Employees of MWH Americas Inc. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she experiences severe pain due to her migraines and cannot perform her daily duties. She alleges she applied for disability benefits and benefits were initially granted, but were terminated upon receiving a later dated Oct. 16, 2015. The plaintiff holds Hartford Life and Accident Insurance Co. and Group Long Term Disability Plan for Employees of MWH Americas Inc. responsible because the defendants allegedly terminated plaintiff's disability benefits despite having adequate medical records to support her claim.

The plaintiff seeks order to pay benefits to plaintiff plus interest, declare plaintiff's rights to receive future disability benefits, all legal fees and any other relief as the court deems just. She is represented by Margaret E. Hasselman, Teresa S. Renaker, and Kirsten G. Scott of Renaker Hasselman LLP in San Francisco.
