OAKLAND – A Texas dentist has filed a class-action lawsuit against a Pleasanton business of sending unsolicited faxes.
Timothy Michael Huckabee, D.D.S., P.A. filed a complaint on behalf of all others similarly situated on June 20 in the U.S. District Court for the Northern District of California, Oakland Division against Atomo Dental Inc. alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that on April 1, he received an unsolicited fax from the defendant. The plaintiff holds Atomo Dental Inc. responsible because the defendant allegedly sent an unsolicited fax advertisement to plaintiff without his consent.
The plaintiff requests a trial by jury and seeks to enjoin the defendant, interest, all legal fees and any other relief as this court deems just. He is represented by Richard T. Drury and Rebecca Davis of Lozeau Drury LLP in Oakland; Steven L. Woodrow and Patrick H. Peluso of Woodrow & Peluso LLC in Denver, Colorado; and Stefan Coleman of Law Offices of Stefan Coleman PA in Miami.
