SAN FRANCISCO – An Alameda County woman alleges her claim for disability benefits was wrongfully denied.
Linda Kachalkin filed a complaint on June 20 in the U.S. District Court for the Northern District of California against Hartford Life and Accident Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that on Aug. 22, 2014, she was found to be disabled and applied for disability benefits. On Nov. 24, 2014, the suit states that her benefit claim was denied. The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the defendant allegedly denied plaintiff's disability benefits without providing reasonable basis to the denial.
The plaintiff seeks payment of disability benefits to plaintiff, reinstatement, order that she is entitled to benefits for as long as she remains disabled under the terms of the plan, interest, all legal fees and any other relief as this court deems just.
