Former Motel 6 employees allege they were not paid overtime wages

OAKLAND – Former employees of a Fremont Motel 6 allege that they were not properly paid and were not given rest breaks.

Maria De Monge Villatoro, Maria Yesenia De Rivera and Monica Rodriguez Ramirez filed a complaint on June 21 in the U.S. District Court for the Northern District of California, Oakland Division against Fremca Hospitality LLC, Sanjib Ghose and Fatima Ghose alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they worked for more than 40 hours per workweek but were only paid a fixed salary with no overtime wages. The plaintiffs holds Fremca Hospitality LLC, Sanjib Ghose and Fatima Ghose responsible because the defendants allegedly failed to pay overtime compensation to their employees, failed to provide rest breaks and provide wage statements.

The plaintiffs seek unpaid wages, compensatory damages, liquidated damages equal to the unpaid wages, interest, civil penalties equal to $50 for the initial violation and $100 for each subsequent violation but not to exceed $4,000, restitution, all legal fees and any other relief as the court deems just. They are represented by Tomas E. Margain and Huy Tran of Justice at Work Law Group in San Jose.
