Sierra Food Group alleges it was not paid for processing nut butters

FRESNO – A Fresno business alleges an Ohio company did not pay it for food processing and packing services.

Sierra Food Group Inc. filed a complaint on June 22 in the U.S. District Court for the Eastern District of California, Fresno Division against D's Naturals LLC and Daniel Katz alleging breach of contract.

According to the complaint, the plaintiff alleges that between March 23 and May 13, it performed all its obligations by processing and packing 17,500 cases of flavored nut butters for the defendants but was not paid for those services. The plaintiff holds D's Naturals LLC and Katz responsible because the defendants allegedly failed to pay plaintiff for processing and packing the nut butters.

The plaintiff requests a trial by jury and seeks payment of $175,386.99 to plaintiff, interest, all legal fees and any other relief as the court deems just. It is represented by David D. Schneider, Matthew R. Dildine and Donald H. Glasrud of Dowling Aaron Inc. in Fresno.
